Elicio Berti, the mayor of Bocaiuva do Sul, 250
miles south of Sa~o Paulo, issued a decree
"prohibiting the presence in this jurisdiction of
members of the class known as homosexuals, who can
bring no benefits of any kind to our people."

A trial has been started against Berti because of
this action. If he is found guilty, he could be

years.

The state prosecutor, Agenor Salgado, maintains
that Berti has violated laws in the Brazilian
constitution against discrimination because of
"prejudices based on origin, race, sex, color, age,
and any other form of discrimination."

In a note accompanying his decree, Berti wrote that
he wanted to promote family interests. He also issued
other decrees that were thrown out by Brazilian
courts. One was against the sale of condoms. Another
was against the sale of cigarettes.
