Folks,
Due to time constraints, I was not able to fulfill my earlier promise of
visiting the site allocated to Taf Holding Company Limited at Brufut.
Fortunately, I was able to do so yesterday, 19th September 2002.
If folks recall, when Taf first contacted me to give his side of the
Brufut Land saga, he sent me a write-up by Mr. Buba Barry (Former
Director of Phyiscal Planning who now works for his company)which
included the following:
"In 1970, the Tourism Development Area (TDA) was legally designated The
TDA covers an area of half a mile – approximately 800 metres, inland
from the high water mark and runs from the Kotu stream to the Alahein
river at Kartong. Part of the area that constitutes the TDA was leased
to
Government, for a period of 99 years, by the Kombo North (from Kololi
point to River Tanji) and Kombo South ( from River Tanji to River
Alahein) District Authorities. The 1988 Greater Banjul Area (GBA) Land
Use Plan 2000 serves as a guiding plan for development in the GBA
including the TDA and contrary to popular belief the Masterplan does not
legally reduce the extent of any part of the TDA".
This was later followed by a scaled map of the area. Prior to that
however, frantic efforts were made to secure and interprete the 1992
Lands Act. I also promised to visit the area to see for myself what is
actually on the ground now and where the said site is located. The
following are my observations:
1. The area in question is located on the left side of the Kombo Coastal
highway, going towards Tanje about 400 Metres after the Gamtel
Drop-Insert station. This Drop-Insert Station was allocated to Gamtel
some 3 years ago. The Kombo Coastal highway runs almost parallel to the
seafront about four hundred Metres (400 Metres) from it. The road and
its side clearings is about 35 Metres wide. On the left is the area
allocated to Taf and is about 200 - 300 Metres deep/wide.
2. With the exception of a motel, belonging to some white folks and
located near the edge of what I was told is the reserve land, I saw two
compounds with roofs towards the edge of the area allocated to Taf. The
rest consists of empty land, two completely fenced but undeveloped land,
several partially erected fences, several plots with their corners
raised to between half a Metre and one Metre.
3. From my observations, it is clear that these structures were put there
within the past two to three years. It is also clearly separated from
the rest of the village by a row of old compounds. I spoke to one
compound owner who told me that he moved to the area in 1988 and that
the area was "Reserve land".
These, folks, are my findings. It is my very strong believe that the
right of government to allocate this area of land to Taf holding cannot
be challenged without challenging the leagality or otherwise of the
demarcation of the area as the TDA, for it is definitely within it, if
Buba Barry's above explanation is anything to go by.
