I don't understand why court cases take so long in Gambia. It is time that
these people are either convicted or released. Justice delayed is justice
denied.

Coup Plot Suspect's Wife Appeals Against Husband's Detention

The Gambia Court of Appeal yesterday commenced the hearing of an application
filed by Haddy Sarr, the wife of Ebrima Yarbo, an alleged coup plot suspect.

Haddy Sarr filed an application seeking the unconditional release from custody
of Ebrima Yarbo on the grounds that he was not taking to court within 72 hours
after his arrest in June 2000.

At the High Court in Banjul, the court ruled against the application noting
that Ebrima Yarbo could not be released under the prevailing circumstances.

Haddy Sarr further appealed against the High Court ruling at the Gambia Court
of Appeal and in the course of the appeal, the DPP made an application to bring
the initial charge and ruling of the magistrate court as well as the
information filed at the High Court against Ebrima Yarbo's detention Lawyer
Ousman Sillah, counsel for Haddy Sarr, objected to the application of the DPP
to submit the initial charge and ruling of the magistrates' court as well as
the information filed in the High Court before the Court of Appeal.

The Court of Appeal however overruled the objection raised by Lawyer Ousman
Sillah and granted the state the relief to bring all the relevant information
to the Court of Appeal in order to decide on the appeal filed by Haddy Sarr,
the wife of Ebrima Yarbo, as to whether to grant the appeal or not.

At yesterday's sitting, Lawyer Ousman Sillah informed the court that he had
filed all briefs in the case. DPP Chief Akomaya Agim also informed the court
that the state had also filed all their briefs.

Both DPP and Lawyer Ousman Sillah craved the court's indulgence to grant any
convenient date so that they could adopt their briefs.

The matter was however adjourned to November 6, for the definite hearing of
their briefs.

The Gambia Court of Appeal was presided over by Justice AD Yahaya (president)
Justice AC Ihekire and Justice GBS Janneh.

It would be recalled that Ebrima Yarbo and five others were alleged to have
planned to overthrow the incumbent government in June 2000.
