JEGGAN STARTS PAYING ELIE
As Court Of Appeal Makes Final Judgement
by Valentine Banjakey

In the long and much publicised legal tussle between Jeggan Grey-Johnson, a rapper, and Elie Nachif, music producer, the Gambia Court of Appeal on Monday July 16, 2001 finally passed a judgement that the appellant, Jeggan Grey-Johnson, should pay D18,000 to Elie Nachif before the deposited D50,000 (to the court) be refunded to him (Jeggan).

Previous judgement on this matter on July 13, 1999 ordered Jeggan Grey-Johnson to pay the sum of D80,000 to Elie Nachif and D3,000 as cost with interest at 12.5 per cent until the amount was paid in full. Elie Nachif later filed a judgement debtor’s summon because Jeggan Grey-Johnson failed to pay and then the high court ordered him (Jeggan) again to pay the sum of D50,000 within fourteen days and D1,500 every month until the amount was paid in full.

Jeggan Grey-Johnson, dissatisfied with this payment arrangement, appealed to the Gambia Court of Appeal.  Justice G Gelega King, made the following judgement, (i) that the appellant (Jeggan Grey-Johnson) be refunded the deposited D50,000, (ii) that the appellant (JegganGrey-Johnson) also pay the respondent (Elie Nachif) D1000 every month commencing from the first day of December, 1999 until the amount is paid in full and (iii) the appellant (Jeggan Grey-Johnson) pay to Elie Nachif, arrears totalling D18,000 which accumulated from December 1, 1999 to date before the D50,000 be refunded to him (Jeggan) which previously was deposited to the court.

Sources close to the judiciary revealed that Jeggan Grey-Johnson on Thursday, July 5, 2001 had already paid the sum of D18,000.

Another judicial source reiterated, “Look, I think it is best for Jeggan to settle this matter outside the courts because you see, with the high court judgement in July 1999, the total sum Jeggan should have paid to Elie was D93,000 including the 12.5 per cent interest rate, the sum went up to D104, 625 and now in July 2001, D117,703.12.

But after paying the sum of D18,000 already, he (Jeggan) should still pay about D100,000 to Elie and of course with a continious 12.5 per cent interest rate annually. If this is not settled outside the courts, Jeggan will have to be paying for ages”, the source concluded.

Justices AD Yahaya and JB Akamba assisted Justice G Gelega King.
