I want gambia's opposition parties to listen carefully. They are worried about Yahya stealing elections but they overlook the cancer in the room...the enabler of Yahya...The IEC. I will try to summarize the significant portions of this article later, for I think it is crucial.

CENI : Le parti SADI dénonce un “putsch” contre l’opposition

Independent Electoral Commission: The SADI party of Hon. Oumar Mariko denounces a "Putsch" against the opposition.

Definitions

Majorite' Presidentielle: In 2007, when ATT contested for another term in office as President of Mali, several opposition parties and Movement Citoyen (now PDES) decided to grace his campaign and formed a bloc to vote for and support ATT's presidential bid. This agglomeration has come to be known as La Majorite' Presidentielle. They included but are not limited to - ADEMA Pasj, URD, CNID-FYT, US-RDA (UM-RDA), PDES, MPR.

Les acteurs politiques se bouffent le nez dans la bataille pour la mise en place de la nouvelle Commission électorale indépendante, CENI. La majorité présidentielle veut s’arracher les 9 sièges sur les 10 réservés aux partis politiques, contre un seulement pour l’opposition. Pour le parti SADI, qui brandit les dispositions de la loi électorale en la matière qui exige un « partage équitable », il s’agit d’un coup de force préparation.

Political actors are embarked on a fight in the formation of a new Independent Electoral Commission, CENI. The Presidential Majority wishes to reserve 9 out of the 10 seats allotted to political parties for themselves and only 1 seat for the opposition parties. For SADI, considering the equitable representation clause of the electoral law, this represents an insiduous and forcible stacking of the decks.

L’opposition s’apprête à porter plainte devant le Tribunal administratif pour « violation de la loi électorale » dans la mise en place de nouvelle Commission nationale électorale indépendante, Ceni.
Les discussions entre majorité et opposition sont sur cale depuis quelques jours autour de la question. A ce jour, les différents acteurs peinent à trouver un consensus autour des quotas de représentativité. Et la rencontre prévue ce mercredi 13 juillet pour la reprise des discussions, ne présage pas un consensus entre les protagonistes.

The opposition is ready to file suit with the administratif Tribunal for "violations of the electoral law" in the formation of the new CENI. Discussions on equitable representation at the CENI, between the Majorite' Presidentielle and other opposition parties have been stalled for some time now. Talks will resume wednesday July 13th, 2011 but a concensus is unlikely on the matter.

En violation de la loi électorale
Sur les 15 membres qui devront constituer l’institution de surveillance des élections, la société civile est représentée par 5 membres, tandis que les partis politiques se partagent les 10 sièges. C’est la répartition de ces places qui provoque aujourd’hui de chaudes empoignades entre majorité et opposition. En la matière, la loi électorale tranche sans équivoque : elle stipule le « partage équitable » entre les deux camps. Or dans la forme actuelle, la majorité présidentielle semble vouloir se tailler la part de lion en raflant les 9 sièges, accordant un seul siège à l’opposition. Celle-ci ne l’entend pas de cette oreille.

Violation of Electoral Law
Of the 15 seats in the new CENI, civil society is allotted 5 while the political parties share the remaining 10 among them. It is the sharing of those 10 seats that elicits such confrontation between the Majorite' Presidentielle and the other pure opposition parties. The law on the matter requires "Equitable distribution of the CENI seats". So the 9/1 formula is grossly inadequate and the pure opposition parties don't wanna hear the cacamayme. I agree with them. What tha hell's wrong with these people?

Pour le parti Solidarité africaine pour la démocratie et l’indépendance, SADI, il s’agit d’un « putsch contre l’opposition ». « Notre démarche est claire, nous voulons appliquer les dispositions prévues dans la loi électorale. Il ne sera pas question pour nous de laisser la CENI entre les mains des partis de la majorité pour organiser la fraude électorale en 2012 » a prévenu l’administrateur du parti SADI, M. Sidi Ongoïba pour qui le blocage tient à la volonté des partis de la majorité présidentielle de violer les textes.

As far as SADI is concerned, it represents a spectacular and revolting coup against the pure opposition. "Our objective is clear; We want the spirit and letter of the law applied. We cannot leave the CENI in the hands of the Majorite' Presidentielle just so they can organize a historic fraud of an election in 2012", said SADI's Administrator M. Sidi Ongoiba, who suspects the Majorite' Presidentielle engineered the impasse at the discussions simply for defaultive violation of the law.

Faux rétorque le camp majoritaire. Qui brandit l’argument que le statut de majorité doit accorder plus de sièges à leur camp dans la nouvelle CENI. Joint par téléphone, le secrétaire à la communication de l’ADEMA-PASJ (qui préside le Comité pour le choix des quotas) n’a pas voulu répondre à nos sollicitations. Entre temps, c’est un dialogue de sourds qui s’installe entre les deux camps. Et le risque d’un blocage est évitable.

The Majorite' Presidentielle on its part, surmises that because they are the majority, they must be accorded the greater number of the CENI seats. We're likely headed for blows.

But 9 out of the 10 available????? What're these people on??? Kolanuts or what??? Besides, when it comes to the INDEPENDENT ELECTORAL COMMISSION, there is no majority. The work of that CENI is supposed to yield the vrai majority. In other words, all parties, large and small, properly registered, and intend to contest the elections, must have representation in the CENI, and that representation must be equal without regard to size of party. Gambia opposition are you listening??? This is what equitable representation means in law. As far as an IEC is concerned, there is no majority party. All bona fide political parties, opposition and incumbent, MUST be on EQUAL FOOTING. That is the whole idea of an INDEPENDENT electoral commission which organizes an election. And an election is what is supposed to determine majority or minority.

This then opens up the other question: Once the FAIRly constituted IEC or CENI completes one election, and given that political party permutations will vary from election to election, should the same CENI or IEC organize subsequent elections without change in its constitution?

I'm glad you're visionary in that question. A CENI or IEC is adhoc as to an election. In other words they are puit together strictly for a particular election. The CENIs or IECs are for the voters and not necessarily for the parties. This is why they are "blind" as to party. THeir composition is supposed to mimic as best as possible, the character of the electorate. Therefore, all of the members of the CENI or IEC must change from election to election, not only the portion reserved for political parties, but the civil society component must change as to personages. This dynamism will enhances the REPRESENTATION/DISTRIBUTION part of EQUITABLE DISTRIBUTION. You may think it is sufficient to maintain the civil society portion but only change the party portion but I say to you that you are inviting other corrosion by individual shortcoming and personal interest. Each individual citizen is as unique as the parties are unique to themselves. Therefore, the uniqueness of a qualitative partner will be the value you accrue to a CENI or IEC for an election to BE SEEN TO BE FAIR. Please don't tell me about idiot International monitors. Please. Angh!!!!!!!!!!! Haruna.

Les élections de toutes les incertitudes
Cette divergence entre les acteurs éclate au grand jour au moment où, le 8 juillet dernier, une réunion au gouvernorat regroupait les différentes parties (société civile et partis politiques) autour de la question. Cette réunion a abouti à la mise en place d’un Comité pour le choix des quotas, présidé par le 1er vice-président de l’ADEMA-PASJ, Ibrahima N’Diaye. Il est secondé, selon les dispositions de la loi électorale, par un membre de l’opposition représenté par Sidi Ongoïba. Ce Comité, précise-t-on, devrait, en principe, adopter son rapport ce mercredi 13 juillet à 17 heures au gouvernorat du district. D’ores et déjà, de fortes inquiétudes demeurent quant à son adoption au regard des divergences de positions. Aux dernières nouvelles, nous apprenons de sources informées, que l’opposition s’apprête à attaquer la décision en justice.

En plus du parti SADI, d’autres partis dits de l’opposition sontfavorables à cette démarche. Il s’agit, entre autres, de RDR, le BARA, l’UMPR, etc. Ils devront constituer un pôle pour attaquer la majorité devant le Tribunal administratif.

La tension autour des quotas à la CENI intervient dans un contexte très particulier du processus électoral de 2012. Alors que les partis peinent à s’accorder sur un fichier électoral, le bras de fer autour de la CENI vient en rajouter au cafouillage dans le calendrier des prochaines consultations électorales. On se rappelle que le vendredi dernier, 32 partis politiques avaient fait bloc pour exiger un fichier biométrique. Au moment où, en face, l’ADEMA, le PDES, etc. et le Comité des experts, optent pour le RACE. C’est donc dans cette situation de forte contradiction que le Mali s’apprête à organiser, dans dix mois, les élections générales de 2012. Va-t-on vers un report ? Les observateurs n’excluent pas l’hypothèse.
