LJDarboe's
lame argument is not grounded in law. It is quite disappointing that
a man who served as a magistrate could display this basic misunderstanding of the
constitution. The provision that he is referring to is dealing not
with who can stand as a candidate but, which association can sponsor a
candidate. For example, the Bar Association as an association cannot sponsor a
candidate for elections. This does not in any way suggest that one cannot run
as an independent candidate. It is quite proper that given this lame argument, one can clearly call for a review of all the cases handled by LJ Darboe as a magistrate.

Here is the whole part
of the constitution dealing with political parties:

 

PART 7: POLITICAL PARTIES 

Political
parties 6 of 2001 60.

 

 (1) No association, other
than a political party registered under or pursuant to an Act of the National
assembly, shall sponsor candidates public elections. 

(2)
No association shall be registered or remain registered as a political party
if- 

 

(a)
it is formed or organised on an ethnic, sectional, religious or regional basis;


 

(b)
its internal organisation does not conform with democratic principles; or 

 

(c)
its purpose if to subvert this constitution or the rule of law. 

 

 

(3)
An Act of the National Assembly shall make provisions for the better
implementation of this section.
