Health Insurance Portability and Accountability Act (HIPAA), Electronic
Medical Records, and Your Practice

Legislators are enacting laws to secure all electronic healthcare
information, ranging from Internet email to satellite transmission of
videoconferencing and all healthcare records. Resulting legislation will
create iron-clad controls for confidentiality, security and data
management. On August 1, 1996, the Health Insurance Portability and
Accountability Act (Public Law 104-191), otherwise known as the
Kennedy-Kassenbaum Act, was introduced in Congress. The Health Insurance
Portability and Accountability Act (HIPAA) called for protections for the
privacy of medical information. It is an attempt to improve the portability
and continuity of health insurance coverage through administrative
simplification by the Congress and the Department of Health and Human
Services (DHHS).

HIPAA includes provisions to address the need for security and electronic
signature standards. These standards will reduce unauthorized access and
alteration of confidential health records by implementing universal
security, integrity, and authentication standards, and will be enforced
through harsh penalties for those responsible for their violation. The
standards will apply to all electronic health data transmitted by health
care providers, health care clearinghouses, and health plans. Standards
will apply to records that are in transit, reside in a practitioner's data
system, or in other databases. Compliance with this law will be required by
February 2002.
