      Doctor resists arrest, assaults police

Interesting news from The Daily Observer

      Tuesday, March 16, 2010

Mbye Faal, a medical doctor at Ndemban Clinic in Bakau was yesterday arrested for allegedly attacking two police officers with a cutlass and assaulting a court process server.

The three said they were acting on a High Court order to arrest Dr Faal, a respondent in a civil suit against Alhaji Pa Harley Ceesay and Charbel Elhajj, at the Sheriff Division of the Banjul High Court. Narrating the incident to this reporter, Corporal Pateh Jawo, attached to the Sheriff's Division of the Banjul High Court said he was ordered by the High Court with another police officer, Corporal Abdoulie Jammeh and the assistant Sheriff Bailiff, Alieu Ceesay, to arrest Dr Faal.

He said when they got to the clinic to arrest the said Dr Faal, they were told that he is yet to report to work that day, so they waited for sometime, but he (Dr Faal) never showed up. Jawo said they then decided to go to his residence at Cape Point. Upon arrival at his residence, we met him and told him that we were ordered by the court to arrest him. He replied that a doctor cannot be arrested by anybody. We then attempted to give him the court order for his arrest for him to read and understand, which he refused to touch.

He then turned back, entered his room while we were standing and waiting. He came out with a cutlass and hit Corporal Abdoulie Jammeh on his right shoulder. When I tried to stop him, he turned on me and hit me with the cutlass and nearly cut off my hand. Though I was bleeding, we managed to grab him and he was later hand-cuffed. We took him to the High Court in Banjul and he was later remanded at the Mile II prison.

      Assault
Previously, Dr Faal was alleged to have assaulted the court process server, Foday Jatta while attempting to serve him (Dr Faal) with the court processes on the respondent on record. Meanwhile he has been remanded and could face different charges based on the alleged offences committed, which include contempt of court and attacking police officers while carrying out their duties; and assaulting the court process services while in the course of their duty to deliver court processes to him (Dr Faal).
