Thursday,June 22nd,2000 around 2.00pm the State filed an appeal against the
ruling of Basse magistrate Borry Touray seeking to have it set aside.If
readers can recall, Magistrate Borry Touray in his ruling at Basse stated
that the he was referring the case to the high court in Banjul but ruled
that the detainees should not be remanded in jail.
Simultaneously an ex-parte summons was also filed seeking order to remand
UDP leader Lawyer Ousainou Darboe & co into custody pending the
determination of the said appeal.Justice Kabalata J. refused to grant the
order sought describing the application as frivolous,vexatious and abuse of
court proceeding and accordingly dismissed it.
Meantime,everyone await the hearing of the substantive appeal.
