Two journalists still held after nearly two 
months because of tough release conditions

Reporters Without Borders today condemned the 
continuing detention of Ebonyi Voice editor Imo 
Eze, and one of his journalists, Oluwole 
Elenyinmi, ever since they appeared in court on 
14 June in response to a complaint by governor 
Sam Ominyi Egwu of the southeastern state of 
Ebonyi.

Eze used to be the governor's chief press 
secretary but became a critic after leaving the 
post. He and Elenyinmi are stuck in prison 
because the judge in charge of the case set very 
tough conditions for their release on bail.

"For the sake of due process, the Ebonyi high 
court must set realistic conditions for the 
release of these two journalists," the press 
freedom organisation said. "They seem to have 
become victims of the falling-out between Eze and 
the governor. Justice should not be turned into a 
means of revenge for powerful politicians 
especially when journalists are exposed to prison 
sentences under Nigeria's obsolete and 
inappropriate legislation."

When Eze and Elenyinmi published an article on 16 
April headlined "Is Ebonyi A Failed State?," 
accusing the state government of mismanagement 
and corruption, they were immediately charged by 
a court in Abakaliki, the capital of Ebonyi, with 
conspiracy, sedition and libelling the governor.

Two days later, the police and the State Security 
Service came to the newspaper to question Eze and 
his staff. Eze told The News, a national daily, 
on 23 May that the investigators kept returning 
during the days that followed. He said he also 
received anonymous calls threatening to kill him 
for criticising the governor.

On 14 June, the two journalists were finally 
brought before a judge, who said he would grant 
conditional release only if they paid 50,000 
nairas (314 euros) each in bail and if a 
permanent secretary or equivalent senior official 
residing within the jurisdiction of the court was 
prepared to stand surety for them.

It is virtually impossible for them to satisfy 
the second requirement because of their relations 
with the governor, especially for Eze, after 
their falling-out.

Their lawyer, Gilbert Ngele, has appealed to the 
Ebonyi state high court for more acceptable 
conditions for their release. While awaiting its 
ruling, the two journalists continue to be held 
in Abakaliki's federal prison.

Deux journalistes maintenus en détention, faute 
de pouvoir remplir les conditions de leur remise 
en liberté provisoire

Reporters sans frontières proteste contre le sort 
réservé au directeur du journal Ebonyi Voice, Imo 
Eze, et à l'un de ses journalistes, Oluwole 
Elenyinmi, maintenus en détention depuis leur 
première comparution, le 14 juin 2006, suite à 
une plainte du gouverneur de l'Etat d'Ebonyi 
(Sud-Est). Le juge chargé d'instruire leur 
affaire a énoncé des conditions ardues pour leur 
remise en liberté provisoire.

"Pour que la justice soit réellement équitable, 
la Haute Cour de l'Etat d'Ebonyi doit énoncer des 
conditions de remise en liberté provisoire 
réalistes. Les deux journalistes incarcérés sont 
apparemment victimes d'un retour de flamme, après 
la rupture des liens unissant l'un d'eux au 
gouverneur. La justice ne devrait pas être 
instrumentalisée pour servir la soif de revanche 
d'hommes politiques puissants, particulièrement 
lorsque, du fait d'une législation obsolète et 
inadaptée, les journalistes risquent des peines 
de prison", a déclaré Reporters sans frontières.

Suite à la publication, le 16 avril, dans le 
quotidien Ebonyi Voice, d'un article intitulé "Is 
Ebonyi A Failed State?" ("L'Etat d'Ebonyi est-il 
en faillite ?"), les deux journalistes ont été 
inculpés par un tribunal d'Abakaliki, capitale de 
l'Etat d'Ebonyi, pour "conspiration", "sédition" 
et "diffamation" à l'encontre du gouverneur Sam 
Ominyi Egwu. Le journal accusait le gouvernement 
provincial de mauvaise gestion et de corruption. 
Deux jours plus tard, la police et les services 
de renseignements intérieurs (State Security 
Services, SSS) sont venus questionner Imo Eze et 
son équipe. Selon le directeur d'Ebonyi Voice, 
interrogé par le quotidien national The News le 
23 mai, les visites des enquêteurs se sont 
multipliées les jours suivants. Le journaliste a 
également affirmé avoir reçu des appels anonymes 
menaçant de le tuer pour avoir critiqué le 
gouverneur.

Les deux journalistes ont comparu une première 
fois le 14 juin. Le juge a conditionné leur mise 
en liberté provisoire au paiement d'une caution 
de 50 000 nairas (314 euros) chacun et à la 
caution morale d'une personnalité ayant le rang 
de Secrétaire permanent, un haut fonctionnaire de 
l'Etat, ou de son équivalent, résidant dans la 
juridiction de la cour. Or, cette deuxième 
disposition est particulièrement difficile à 
satisfaire, étant donnée la situation des 
journalistes par rapport au gouverneur, et 
singulièrement celle d'Imo Eze, qui est son 
ancien attaché de presse.

Leur avocat, Gilbert Ngele, a introduit un 
recours auprès de la Haute Cour de l'Etat, en 
demandant des conditions de remise en liberté 
provisoire plus acceptables. Dans l'attente de 
l'arrêt de la plus haute juridiction provinciale, 
les deux journalistes sont emprisonnés à la 
prison fédérale d'Abakaliki.
