The election  decree provides that it has to be held within 90 days after
the seat became vacant. As long as that requirement is met, the discretion
is entirely IEC's  and I don't think the opposition will have a leg to stand
on in arguing against this unless they can show that IEC's discretion as
exercised was somehow  fettered, which will be very difficult if not
impossible to prove.

The point is; we cannot always expect things to fall our way. We have to be
ready to accept challenges and be proactive in working out our ways around
them.
