Pa Saikou
You and YJ are both correct about the South African Judiciary and some very fine decisions are indeed coming from that country's independent judges.
If you have
time, please have a look at this prior restraint judgement by the South African Constitutional Court:   Print Media South Africa and Another v Minister of Home Affairs and
Another (CCT 113/11) [2012] ZACC 22; 2012 (6) SA 443 (CC); 2012 (12) BCLR 1346
(CC) (28 September 2012)

My Lord LJD, or should I say Your Honor,I think Yoro touched a little bit on my point. In Southern Africa, I assumed that the Judiciary is to a large extent, if in fact not totally independent of the Executive and the Legislature, and therefore one can rightly conclude that there is a rule of law that the Judge in this case relied on, and without fear or favor for that matter. In The Gambia, on the other hand, there is only a virtue separation of power, not really existing. Yaya Jammeh, is the Judge, the Jury, and the Executor. He runs the Executive branch, the Judiciary, and the Legislature. I want to convince myself that cases involving so called "high profile" civilians and military personnel(former Jammeh cohorts), Yaya,
through the Attorney General would directly remote control the
process to make sure that any outcome meets his desired objective. "Sembocracy" as the AFPRC/APRC thugs would call it. These cases may be similar to the late Imam. Karamo Touray's case, a case you're very familiar with. Even if charges are leveled against the D, they are usually bogus and unworthy of any serious court's valuable time to even consider, let alone preside over it in a trial. My view.
Pa. Saikou Kujabi.
